Terms of Service for Realty IQ

Introduction

Acceptance of Terms

By using the Realty IQ app (“the App”), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, do not use the App.

Eligibility

You must be at least 18 years old to use the App. By registering, you confirm that you have the legal capacity to enter into this agreement.

Agent Subscription Fees

Agents are required to pay a monthly or annual subscription fee to use the App, with discounts for annual payments. All payments are securely processed via third-party payment providers. Fees are non-refundable, except as required by law or at our discretion.

Subscription Renewal & Cancellation

Subscriptions auto-renew unless canceled before the renewal date. You may cancel at any time via your account settings or the platform used (App Store/Google Play). Refund policies are subject to the terms of the respective platform.

User Responsibilities

All users must:

  • Provide accurate, up-to-date information

  • Use the App lawfully

  • Refrain from actions that may harm Realty IQ, its users, or its services

Relationship Between Agents and Clients

Realty IQ facilitates communication between Agents and Clients. We are not real estate brokers or intermediaries in property transactions. Agreements or disputes between Agents and Clients are solely between those parties. Realty IQ holds no liability for transaction outcomes.

Accuracy of Calculations

Realty IQ provides mortgage, rental income, and cost-to-sell calculators for informational purposes only. Results may vary, and Realty IQ does not guarantee accuracy or reliability. Users should consult a qualified financial professional before making decisions based on these tools. We are not liable for damages, losses, or disputes arising from use of these tools.

Intellectual Property

All content, branding, designs, features, and logos within the App are the exclusive property of Realty IQ, LLC. Unauthorized use, reproduction, or distribution is prohibited.

Third-Party Services

The App may include links or integrations with third-party services. Realty IQ is not responsible for third-party content, policies, or practices. Use of third-party services is at your own risk.

Limitation of Liability

Realty IQ is not liable for any direct, indirect, incidental, or consequential damages arising from your use of the App, including but not limited to real estate transactions, inaccurate information, or service interruptions.

Disclaimer of Warranties

The App is provided “as-is” without warranties of any kind, express or implied. Realty IQ disclaims warranties of merchantability, fitness for a particular purpose, and non-infringement.

Force Majeure

Realty IQ is not responsible for delays or failures due to causes beyond its reasonable control, including natural disasters, technical failures, or acts of government.

Termination

We reserve the right to suspend or terminate accounts for violations of these Terms. Fees paid prior to termination are non-refundable.

Dispute Resolution

Any disputes will be resolved through binding arbitration under Hawaii Arbitration Rules or Dispute Prevention & Resolution, Inc. (DPR) in Honolulu, Hawaii. Legal claims that cannot be resolved via arbitration are subject to Hawaii state or U.S. District Court jurisdiction.

Modification of Terms

We may update these Terms of Service at any time. Significant changes will be communicated via email or in-app notifications. Continued use of the App after updates signifies your acceptance.
